I think the latest statistics for US is....one person every half an hour is a victum of a drunk driving incident..
(Someone wanna fact check me here, that would be cool)

Whatcha think....Are the current laws too lenient, to strict?

A first time offender, is probation enough?
If they continue to drive on a suspended license during probation (There are "hardship licenses"...for those to get back and forth to work, excluding that..) should there be automatice jail "shock time"

I think in Missouri, it's a automatic 1 years suspended driver's license, and a substance abuse classes that must be paid for and completed before getting your license back.

I see too many people who are repeat offenders, and I too, think the laws are way too lenient...

Best friend's brother has a serious alcohol problem. Has had his license taken away in more than one state... but he "cleans up good" so he has only gotten jail-time once or twice. So far, every judge he's dealt with has chosen to be lenient, instead of putting him UNDER the jail...

Cold as it sounds, my BF is left to hope that if/when his next accident happens, the only person that gets hurt or killed is him....

I think the first one they only get probation, dumb dumb classes, and a hefty fine. Unless they are involved in an accident where someone other than them gets hurt. Then it should be go to jail, fine, dumb dumb classes, and lose their license. But after the first one, it should an automatic jail time, bigger fines, more dumb dumb classes, lose of license for a longer period of time. We have had some clowns with 10 +++ DUI's and they are still on the streets, and they are driving without a license.

This is my feeling also. I'm not sure what the penalties are in SD but I'm just as sure they aren't strict enough. I also feel that speeding, driving while over tired and those that are "multi-tasking" while driving should have much stiffer penalties. Say on the first offense-- one year suspension with 6 months no work license. That'd get their attention!! Also a $5,000 fine for the first offense would be good too.

I have to deal with these things many times every day.

Oh!, one other thing. I forget which one, but one South American country the penalty for 1st offense DUI is death!

you get probation, and lose your license for 6 months....the second offense gets you two years probation, thirty days on house arrest and the loss of your license for two years as well...
at least that's what happened to a kid i work with...
2 dwi's in less than two years time, and he's only 22..

I hate that it is way too common for someone to just keep driving after one offense, let alone 2 or more!
Out here in this rural area, I'm sad to say, many a convicted drunk driver just ends up driving anyway, some taking the back roads to the bars and back home again.

Ya know what...if I'm EVER caught drinking and driving...let 'em lock me up from the git go!!!

I'm not an alcoholic, I have a few drinks every couple of weeks at the most, I'm happy driving up to the store, buying my bottles, driving all the way back as sober as I drove there...and having my drink or two on my back deck...

And once I've had that drink...there's no way I"m driving anywhere!!

I understand that you maybe perfect in that respect, but what if you had an emergency and no one could drive you, I am sure you would take the chance and drive, even one drink could put you over in some states.
I do not even drink at all, and I got pulled over for a license plate over due sticker, while taking empty cans to the recycle yard and the officer could smell beer from my sons party a few days before, he told me he could have arrested me for transporting open licquor, he even gave me the breathalizer and made me walk the line before letting me go,,,so you never know for sure what could happen Sweetie,,

i'm not saying that i haven't done it in the past.
but i usually try to stop drinking an hour before i plan on leaving the bars...but nowadays, if i drink...i drink at home, or have a sober driver. it's just not worth it. a buddy of mine got in trouble, he had 3 beers in an hours time, didn't feel drunk, stopped at a gas station afterward, some one else hit his car, the cop smelled alcohol, gave him a breathalyzer test...busted. he wasn't even in the car when the other guy hit him..

i am with you lonely, after getting my DUI in 1988 , i stopped drinking for just over 13 years. when i started again in 2001, i ONLY drink at home, OR have a sober person do the driving. am i scared ?........DAMN RIGHT !!!!!

Here's one to ponder... Massachusetts wants to change the legal drinking limit from .08 to .04 (cut in half). At the present, one beer makes you legally intoxicated for up to 30 minutes (less with food). With the change, the average person would be legally intoxicated for upwards to 1 hr after that drink, no matter if it was consumed with food or not. Is that right? Should anyone be assumed to be an alcoholic after one/a drink?

In Missouri. we even have zero tolerance laws for anyone under 21 who takes a breathalizer test...

Ya know...I'm such a stinker about drunk driving, and I think I may have to just lay off the topic for awhile...it's beginning to bring back those vivid pictures in my head of that day...that beautiful clear summer day on that stretch of rural highway, the farmer just wanting to go aways down the road to turn into his pasture to feed his cattle, the drunk speeding up to his tailgate, the horrible crash I saw happen right in front of me, the car tumbled in the air over and over before it hit that steep ravine, the woman passenger broken and cut in that twisted heap, screaming, crying, moaning...all while her companion, the drunk driver, crawled around on all fours outside the wreckage where she lay, trying to pick up and hide as many beer cans as he could before the cops got there...

Sadly, that is not the only incident in my memory of lives lost, lives ruined from a drunk driver...I just want to try to get these images out of my head again...

So..I'll just say...it's so wrong to do it...please don't.

I can understand how hard it is for you Chazzy to get these images and thoughts out of your head, as i have lost friends and family to drunk drivers, anyone who has gone through this has the right to feel so strongly about this subject.
I have never driven even after having one drink, and i would Never do it in the future. Just a shame not everyone does the same.

A few years ago a family was on their way home from a day at the beach. They had just pulled out from the light when a car came speeding the other way running the red light.
The man and his wife were killed and the two young boys in the back seat were in the hospital for months.

The driver of the car that hit them was not injured
The accident scene was a mess

The cause: A drunk driver

The result: He got 6 months probation for a first offense
even though two died

Please don't drink and drive

I'm sorry for appearing to be so unreasonable in this thread and the Paris thread, but if some of you could have just seen this, the bastard's first thoughts and priorities were not for the critically injured women in the heap of the car he was driving, if you could have seen this fucker crawling and scrambling on all fours trying to make sure all his beer cans were hid... you'd be totally unreasonable and passionate about it too

Chazzy, there is no reason to apologize for this. I've had to pull many people out of mangled cars, dirty ditches, or just plain out of the back end of a pick-up, frozen stiff, all because of alcohol. Those are the images that are always with me. If I was too drink and drive, and something would happen, I'm not prepared to live that. If anyone thinks that they are prepared for it, are damn liars. Anytime Ma and I are out, I never drink. I'm the sober one and able to drive. If I want to have a drink or two, it will be hours before I have to leave. You can have a little alcohol while having fun, but that doesn't mean you have too drive. There is always an alternative. No exceptions.

It's hard enough to live with this one incident, the memory never seems to fade, and can only be suppressed...the whole thing just keeps playing over and over like a bad recording.... I can't imagine having many of these horrible memories...takes a strong person to do what you do for sure, flp...

I haven't been on the rescue squad for several years now, but I do miss it a lot. There is no higher high than arriving at the scene, and knowing the person is dead, but you work your tail off and god has given you the good fortune to bring them back to life. But when god says " no not this time " its rip's your gut right out. Most of the emergency response personnel are always in post traumatic shock. These people run from one bad scene to the next. That's why they have such a high rate of divorce, alcoholism, show's signs of anti-social behavior. These people are a very tight net group, and do not let others in their circles. They depend on each other for support and for their very lives.

You certainly have nothing to apologize for, so many people get hurt and killed due to drunk drivers and the poor families who are left behind to deal with their loss for the rest of their lives. All these tragedies could be stopped if selfish thoughtless people stopped driving while they are drunk. You can drink safely at home and there are taxis, or for the richer people they can afford a driver, so there is no excuse.
Chazzy I'm sending you a hug, you are a caring considerate person, be proud of you, don't apologize.
For not agreeing with people who drink and drive is far from being unreasonable, anyone who thinks there is nothing wrong with it, has the problem

Unfortunately, driving drunk affects more people than most people realize. I happen to be the only male in my family that does not have a DUI/DWI. However, I CAN tell you that the system started out rather shabby.. or practically non-existant for the most part. I'm not sure as the the exact particulars, but Ohio has really stepped things up with DUI's/DWI's to the point where they are permanently revoking licenses for life much sooner than they did in the past. People in this state were tired of hearing about someone on their... 22nd or 30th offense.

As for these programs.. let me tell ya.. the ones around here are a joke. I have known many people who have gone through them with no effect. OH.. and those breathalizers that they install on your car so you can drive.. yea.. yea.. yea.. . I've known people to have those... and they just had someone else blow into it.. and.. go on their way. We can send a man to the moon, but.. we can't fix this... come on!

Yes.. stiffer penalties and we need to make sure that the programs we have in place are actually doing something. Real people are dying, and that is the true tragedy of it all ... above all else.

Yes Chazzy... I understand. With many people out there driving under the influence at any given time, the roads are a russian roulette situation at best. Thinking about this since my earlier post, I am believing that there is a solution to the "hack" to the breathalizer installed on cars. Perhaps the breathalizer can function so that it is not only necessary to start the vehicle, but to operate it as well. How to do so might u ask?.. well i have an idea for that too.

Instead of the "stem mechanism" they have now, make it into a small wearable type mask that intakes their respiration... that would allow for constant and random checks as long as the vehicle is in operation. Now, you might think that it is very silly to go down the road that way.. however, their vanity is not the concern here. If they didn't want something like that to come about, perhaps they should have thought about that before they drove drunk and got busted.

The technology is definately out there, and if equiptment makers want an insentive to jump on this band wagon... let me tell them that the equiptment would be expensive and demand a huge profit for them. Should we approach more things like this example, perhaps we can finally get more control to the situation. I know it is something that is after the fact, as the only cure comes within each and every person before they drive!

I heard they just came out with a new one. Not only does the machine measure alcohol intake, but is sensitive to the offenders DNA too. If anyone else blows in it, not only will it not start, but it sends a signal to the local police station. The machine is suppose to be a one-time-use if someone else does the blowing. At a cost of around $5,000 per unit, a drunk will now have to think twice before his buddy gives his car a blow-job...

I think some of the installed auto breathalizers not only start the car, but are timed, so an alarm goes off every so many minutes and you have a very short amount of time to blow again in order to keep the car from shutting off...
