A female judge has dismissed charges against a Virginia man accused of taking pictures up women's skirts at the Lincoln Memorial.
a Judge said in her ruling women should have no expectation of privacy in a public place.
Records show in 2013 U.S. Park Police spotted a male suspect on the steps of the memorial lowering his camera when ladies walked by. Authorities later found he had a collection of upskirt pictures taken from that spot.
The U.S. attorney's office recently had to drop the case after the judge ruled it couldn't use the evidence.
"This court finds that no individual clothed and positioned in such a manner in a public area in broad daylight in the presence of countless other individuals could have a reasonable expectation of privacy," the judge said in her ruling.
she acknowledged his intentionally photographing publicly exposed areas of women's bodies was repellent and disturbing, but she said his actions weren't enough to arrest him.
Some tourists around the memorial disagreed and mocked the decision.
"I mean, this is like purposely trying to look at you," Judy Hannah said. "Taking pictures, I don't think that's right. The moral of the story is always wear pants."

I was sitting at the airport with my daughter a couple of years back and she noticed a guy taking pictures of me. From the way he was sitting and holding his camera, it looked like he was taking pictures of my legs. I have to admit it creeped me out a little bit. I have had people take pictures of me quite a few times in public but they either ask or at least don't try to hide it.This guy was just doing it in a way that made both my daughter and I uncomfortable. She wanted me to tell the security guard. But what was I going to say "Hey security guy, please through that guy out of the airport for taking pictures of my legs?" I did make eye contact with the guy and he knew I caught him but he didn't stop. I just tried to ignore it and made a joke about it to my daughter. I think if I felt he was taking Up-skirt shots or down either of our shirts I would not have taken it so lightly.
Laws are funny when it comes to being in public. I think the guy is a pig for what he was doing at the monument but we have to take the good with the bad when it comes to laws. You are in public. Cover up if you are that worried. Based strictly on law not my opinion on weather he should be allowed on a moral standing.The judge made the right call.
